O presidente Jair Bolsonaro disse nesta quinta-feira (1º), durante live no Facebook, que o governo está preparando um projeto para legalizar o garimpo no país. Ele não deu detalhes sobre a medida, mas ressaltou que o tema será levado à apreciação do Congresso e que, na próxima semana, deve anunciar mais informações.
“Nós estamos trabalhando, via Ministério das Minas e Energia, num projeto que vai passar pela Câmara e pelo Senado. Eu não vou impor nada, a gente espera que tenha uma aceitação”, disse. “Por que o nosso garimpeiro não pode, de forma legal, pegar uma bateia e peneirar areia num lugar qualquer e tirar o ouro para seus sustento?”, acrescentou o presidente, reforçando que a ideia é dar dignidade para categoria e conciliar a atividade com a preservação ambiental.
Segundo o presidente, a ideia é viabilizar a permissão para que haja exploração mineral também em áreas indígenas, o que hoje não está previsto na legislação. “No que depender de mim, vai depender do Parlamento, eu quero que o índio, se quiser garimpar na sua terra, que garimpe”, acrescentou.
O Artigo 231 da Constituição Federal condiciona atividades minerais no território indígena à prévia autorização do Congresso Nacional e à concordância da população indígena que vive no território. Pela Constituição, as reservas tradicionais demarcadas são de “usufruto exclusivo” dos indígenas, incluindo as riquezas do solo, dos rios e dos lagos nelas existentes.

Ministry prepares project to legalize gold mining

“We are working, via the Ministry of Mines and Energy, on a project that will go through the House and the Senate. I will not impose anything, we hope you have an acceptance, ”he said. “Why can't our prospectors legally take a batter and sift sand anywhere and take the gold for their livelihood?” He added, stressing that the idea is to give dignity to the category and reconcile the activity with environmental preservation.
According to the president, the idea is to allow the possibility of mineral exploration in indigenous areas, which is not foreseen in the legislation today. "As far as it is up to me, it will depend on Parliament, I want the Indian, if he wants to pan in his land, to pan," he added.
Article 231 of the Federal Constitution conditions mineral activities in indigenous territory upon prior authorization by the National Congress and the agreement of the indigenous population living in the territory. According to the Constitution, the demarcated traditional reserves are “exclusively enjoyed” by indigenous people, including the riches of the soil, rivers and lakes in them.
